IHC bars ‘coercive measures’ against legally operating sheesha cafes

The Islamabad High Court (IHC) has formally issued its written order from the September 9 hearing, barring authorities from taking “coercive measures” against restaurants that are legally operating and serving sheesha under valid permits.

While reiterating its directive for the district administration to formulate comprehensive rules for sheesha cafes within one month, the court clarified that lawful businesses should not be subjected to undue pressure. The order specified that police should continue to take lawful action against any illegal sheesha-related activities or violations of permits.

The court also noted that the proposed 'Prohibition of Sheesha Smoking Rules 2023' remains pending with the federal government.

In a detailed order regarding sheesha cafes in the capital, the Islamabad High Court (IHC) has directed the government to finalize and implement rules for such establishments within one month. The court also ordered the federal cabinet to expedite the approval of laws aimed at banning sheesha smoking.

While reiterating its previous order protecting legally operating businesses from forced or illegal action, the court instructed the Islamabad police to continue strict enforcement against illegal sheesha cafes. It also directed the Anti-Narcotics Force (ANF) to cooperate with the police in efforts to eliminate drug use.

The court expressed concern over the lack of a legal framework for sheesha cafes, stating it is the government's responsibility to protect the younger generation from drugs and sheesha smoking. It has sought a response from the federation in the case and demanded a compliance report on the finalization of rules within one month.

The IHC has consolidated all related petitions and adjourned the hearing until October 13.
