The petitioner, PPP candidate Attaullah Khan, had challenged the result, arguing the returning officer issued Form 49 without counting postal ballots. The tribunal's judgment, issued on Friday, noted that the returning officer had no authority to issue a provisional consolidated result and that the Chief Election Commissioner had committed a "serious error" by issuing a declaration based on it.
The court cited Section 95 of the Elections Act 2017. It was also clarified that the winning candidate, Malik Imam, had joined the Istehkam-i-Pakistan Party (IPP) after running as an independent.
