During the hearing, petitioner Sher Afzal Marwat argued that former Chief Minister Ali Amin Gandapur's resignation was not voluntary but was given on the direction of the PTI founder, which he claimed was unconstitutional. He contended that the manner of Gandapur's removal violated Article 130(8) of the constitution.

The court has now also issued a notice to Ali Amin Gandapur. The bench, which included Justice Baqar Najfi, heard arguments that a person disqualified from public office cannot run the government by proxy.
